  1. Definitions

In these general terms and conditions the following definitions apply:

  • Reflection period: period within which the consumer can make use of his right of withdrawal.
  • Consumer: natural person, not acting in the exercise of a profession or business and who enters into a distance contract with Prints by Iris.
  • Day: calendar day.
  • Durable data carrier: any means that enables the consumer or Prints by Iris to store information addressed to them in a way that enables future consultation and unaltered reproduction of stored information.
  • Right of withdrawal: right of the consumer to withdraw from the distance contract within the specified cooling-off period.
  • Prints by Iris: the natural or legal person who offers products remotely to consumers.
  • Distance agreement: agreement between consumer and Prints by Iris, established at a distance by using a system intended for this purpose.
  • In writing: In writing is also understood to mean electronic communication, such as e-mail, provided that the identity of the sender and the authenticity of the communication are sufficiently established.

  1. General
  • These general terms and conditions apply to every offer from Prints by Iris and to every distance contract concluded between Prints by Iris and the consumer.
  • The agreement is concluded at the moment that the consumer accepts Prints by Iris's offer and meets the conditions set for that offer.
  • Prints by Iris will immediately confirm receipt of the acceptance of the offer. Until Prints by Iris has sent this confirmation, the consumer can dissolve the agreement.
  • As an exception to paragraph 2, the agreement is only concluded after Prints by Iris has been informed, within the legal frameworks, whether the consumer can meet his payment obligations and of other facts and factors that are important to conclude an agreement in a responsible manner. distance. If there are sufficient grounds for refusal, the retailer has the right not to enter into the agreement, or at least to dissolve it or to attach special conditions to the agreement.

    1. Dissolution right
    • The consumer has the right to dissolve the agreement without giving any reason within 14 days after receipt of the product by the consumer or a representative designated in advance by the consumer.
    • During this period, the consumer will handle the product and packaging with care. The consumer will only unpack or use the product to the extent necessary for the assessment of the product.
    • If the consumer wishes to make use of the right of termination, he must report this to Prints by Iris in writing within the reflection period. Prints by Iris will immediately send a confirmation of this message.
    • Products must be returned to Prints by Iris together with all supplied accessories and as much as possible in the original condition and packaging, in accordance with the clear and reasonable instructions provided by Prints by Iris.
    • In case of dissolution, the costs of the return shipment will be borne by the consumer.
    • After dissolution, the consumer must return the product within 14 days in accordance with the provisions of paragraph 4.
    • Prints by Iris will reimburse the payments received from the consumer within fourteen days after dissolution.

      1. Exclusion Right of Dissolution
      • The right of withdrawal is excluded for the following products:
      • that have been created by Prints by Iris in accordance with the specifications of the consumer;
      • that are clearly personal in nature;
      • that cannot be returned due to their nature;
      • that can spoil or age quickly;
      • whose price depends on fluctuations in the financial market over which Prints by Iris has no influence;
      • for individual newspapers or magazines;
      • for audio and video recordings and computer software of which the consumer has broken the seal.

        1. Delivery
        • The place of delivery is the address that the consumer has made known to Prints by Iris.
        • Prints by Iris will deliver orders within 30 days, unless a longer delivery period has been agreed. Prints by Iris will report delays in delivery in good time.
        • The consumer has the right to cancel if delivery takes place or can only take place after these 30 days without prior agreement. Prints by Iris will reimburse the payments received from the consumer within thirty days upon dissolution.
        • The risk of damage or loss of products transfers to the consumer at the moment of delivery to the consumer or a third party designated by them in advance.

          1. Warranties and Conformity
          • Prints by Iris does not offer any (additional) guarantees with regard to delivered products.
          • Products must meet the reasonable expectations of consumers. Apart from the usual wear and tear, products may not show any defects during the expected life of the product.
          • If a defect turns out to be a manufacturing defect, the consumer is entitled to repair of the product. If repair is no longer possible or it costs a disproportionate amount of money, the product will be replaced. Only when the product is no longer produced or if repair or replacement exceeds the value of the product to an unreasonable degree, Prints by Iris may offer to reimburse the purchase price to the consumer.
          • Compensation, repair or replacement due to the defect in a product will lapse if the defect has arisen as a result of or results from careless, injudicious or improper use thereof or use after the expiry date, incorrect storage or maintenance by the consumer.

            1. Complaints and Disputes
            • Only Dutch law applies to agreements between Prints by Iris and the consumer
            • Complaints about the execution of the agreement must be reported fully and clearly described in writing to Prints by Iris within a reasonable time, but no later than 14 days after the consumer has discovered the defects.
            • Complaints submitted to Prints by Iris will be answered within 14 days of receipt of the complaint. If the complaint cannot be resolved within 14 days, Prints by Iris will report this in good time and give an indication of the period within which the consumer can expect a solution.
            • Prints by Iris informs the consumer of the possibility, if Prints by Iris and the consumer do not reach a solution together, within 12 months after reporting the complaint to Prints by Iris, to submit the complaint to the Online Dispute Resolution of the European Commission via https://webgate.ec.europa.eu/odr or directly with the General Disputes Committee https://www.degeschillencommissie.nl/over-ons/commissies/algemeen/
